Government of Québec proposes new regulation for retail signage

As a response to the decision of Québec (Procureure générale) v. Magasins Best Buy ltée, 2015 QCCA 747, the Government of Québec recently announced that it intends to bring forward a new regulation requiring companies with non-French names to add wording in French to their exterior signs.

No copyright and trade-mark rights in most metatags

This case is the most recent in a small line of cases concerning the intellectual property implications, or lack thereof, in using website metatags formulated based on a competitor’s website or trade-marks. While the Court’s findings are fact specific, many aspects of the decision may make it difficult for brand owners to assert rights where they find that their trade-marks or trade-names have been used as metatags in a third party competitor’s website.

Substantive patent and design amendments bring Canada in line with its treaty obligations

The Government of Canada introduced for first reading in Parliament numerous amendments to intellectual property and other statutes on October 23, 2014. Bill C-43, an omnibus budget bill, amends Canada’s Patent Act to conform to the Patent Law Treaty (“PLT”) and the Industrial Design Act to conform to the Geneva (1999) Act of the Hague Agreement Concerning the International Registration of Industrial Designs.
